RestorePro has provided several e-mails outlining the new EPA Lead Abatement Law, which had an original effective date of April 22, 2010. Along with many other competent, law-abiding restoration companies across the country, we worked diligently to get our people trained and began compliance with the new EPA guidelines even before the April 22 deadline. These guidelines are beneficial to you and your clients, unfortunately, a majority of contractors and companies who are obligated to comply with these new regulations have not complied. Sadly, we believe that regardless of time, market conditions, or laws, many are openly turning a blind eye to the EPA laws and compliance date.
Regardless of the reasons why so many contractors failed to comply with the deadline date, lawmakers and special interest groups went to work to get the deadline extended, citing lack of trainers as the need for the extension. As of this week, the Environmental Protection Agency said it will delay until Oct. 1, 2010 enforcement of the rule that requires contractors to take additional precautions when renovating houses where children could be exposed to lead dust from old paint.
The EPA rule requires contractors to use "lead-safe" practices when working on homes, day-care centers and schools built before 1978, the year lead paint was banned for residential use because of health risks. The delay allows contractors to sign up for training by Sept. 30. Training must be completed by Dec. 31. According to the EPA, the decision gives contractors more time to file needed paperwork to demonstrate they are following lead-safe work practices, as well as more time for contractors to enroll in and complete the required training courses.
RestorePro believes a delay in enforcement should not translate into a lead poison risk exposure to you or your clients. No level of enforcement, it appears, is going to guarantee compliance, otherwise, this delay would not have become political folly.
